Terms of Service — ARchive

These terms govern your use of the ARchive app and the sync service behind it ("the service"). By using ARchive you agree to them. If you do not agree, do not use the app.
ARchive is operated by Three Eyed Emu (ABN 60 976 457 601) ("we", "us"). Contact: xraycontainervision@threeeyedemu.com.au.
1. Who can use ARchive
You must be 18 or older. By creating an account you confirm that you are.
2. Your account
- You may use ARchive without an account. Some features — sync between devices and household sharing — need one.
- Keep your password and your device secure. You are responsible for activity under your account.
- One person, one account. Do not share credentials.
- We may suspend or close accounts that break these terms. We will tell you why unless the law prevents it.
3. Early access
ARchive is in early access. Features may change, be added, or be removed, and the service may be interrupted for updates. The app is free during early access. If any feature becomes paid in future we will tell you in advance and it will never be applied retroactively.
4. Your content
You own the photos, labels and notes you create. To run the service you grant us a limited, non-exclusive licence to store, copy and transmit that content only as needed to provide sync and the household sharing you set up. We do not use your content to train AI models, sell it, or share it with anyone beyond what is needed to run the service and what is described in our Privacy Policy.
When you delete your account, we delete your cloud content within 30 days. Content on your device is yours to keep or delete.
5. Acceptable use
Do not use ARchive to:
- store or share unlawful material;
- catalogue stolen property or plan any unlawful activity;
- access, or try to access, another person's data without their consent;
- probe, scrape, overload or reverse engineer the service;
- misuse the optional cloud recognition features in ways that breach the third-party provider's terms;
- harass, threaten or defame anyone.
6. Household sharing
When you create or join a household, the inventory you share becomes visible to its members according to their role. You are responsible for whom you invite. You can remove a member at any time and their access ends immediately. Invites are single-use and expire after ten minutes.
7. Third-party services and your own API keys
ARchive can optionally send a photo to Google Cloud Vision, or — if you supply your own API key — to OpenAI or Anthropic, to recognise items. When you enable any of these, that provider's terms and privacy policy apply to that data flow in addition to ours. We do not control their availability or pricing.
If you supply your own API key you are responsible for that account, its costs, its rate limits, and keeping the key secure. The key is stored only on your device.
8. Availability and warranty
We work to keep the app and the sync service running, but we do not guarantee uninterrupted or error-free operation. Recognition results are suggestions and can be wrong — check them before relying on them. To the extent the law allows, the service is provided "as is" and we exclude implied warranties.
Nothing in these terms limits any guarantee, right or remedy you have under the Australian Consumer Law or any other consumer law that cannot be excluded.
9. Liability
To the maximum extent permitted by law, our total liability to you for claims arising from the service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential loss, or for loss of data that you could have backed up using the Export Data feature.
Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be excluded under your local law.
10. Ending things
You can stop using ARchive at any time. To close your account and delete your cloud data, use Settings › Account › Delete Account in the app, or follow Delete your account and data.
We may suspend or close your account if you breach these terms. We will give reasonable notice unless the breach requires immediate action.
11. Changes to these terms
We may update these terms. The "Last updated" date changes when we do, and for material changes we will notify you in the app before they take effect. Continuing to use the service after that date means you accept the updated terms.
12. Governing law
These terms are governed by the laws of Australia and of the State or Territory in which the operator is established, and disputes are subject to the courts there — except that if you are a consumer elsewhere, you keep any non-waivable right to bring a claim in your own country.
